Representatives of * NDV – Real Estate Supermarket, threatening to sue, appealed to the Anti-Raiding Center via a Facebook page with a request to remove the news “Supermarket of someone else’s real estate” published on the Center’s page on July 29.
In their appeal, they said that “the company (NDV – author) works on the basis of a contract with a co-investor and implements its volumes, and not the comfort of the investor” (spelling and punctuation marks are preserved). If the information is actually correct, then it turns out that NDV sells apartments that do not belong to the developer, that is, to the company “SZ” ComfortInvest “LLC, which is responsible for the construction of the complex to equity holders and the state, plus apartments belonging to third parties.
In fact, this means that NDV sells secondary real estate, and the proceeds from the sale of apartments in the Riviera can be used in the interests of third parties, completely different from the interests of equity holders.
At the same time, the publication which includes the start of sales of apartments in the Pirogovskaya Riviera by NDV – Real Estate Supermarket on the RBC website contains a quote from the representative of the group that controls ComfortInvest, Sergei Ilyasaev, which says: “… competent organization of the sales process and consulting by“ NDV-Real Estate Supermarket “will achieve the highest results.”
Sergei Ilyasaev was previously repeatedly seen at the Riviera construction site, although he was never appointed and approved by the founders to any leading positions. In this photo, taken presumably in April 2019, Ilyasaev is seen in the company of Flera Teplinskaya, who is well known to the founders of ComfortInvest. According to CCTV footage at the SDI Group office, Ms. Teplinskaya was one of the people who entered the SDI Group office on Kutuzovsky Prospect to establish control over the informal holding.
This operation was performed back in January 2019. From the office in Kutuzovsky, Ms. Teplinskaya negotiated with God Semenovich who gave guidance to the management of SDI companies. At the request of Vladislav Yusupov (formally in no way connected with the holding), all top managers who worked in SDI Group had to obey Teplinskaya.
Linguistic experts interviewed by the center draw attention to the fact that the statement about the organization of the sales process is expressed in the present tense and without speculative assumptions in the form of, for example, the subjunctive mood. Experts conclude that this quote may well be perceived as a statement that cooperation between NDV and the developer is still ongoing, and it concerns the sale of apartments.
And why is the NDV company, which (as it is written in the appeal) “prepares a proposal for the implementation of the project for the developer (ComfortInvest – auth.)” Is so “embarrassed” to work with the developer of the Riviera in terms of selling housing? The founders of the developer are inclined to believe that if the company itself did not see anything shameful in the sales of apartments at ComfortInvest, it would openly declare this.
The appeal of the NDV representatives also repeatedly reiterates their unwillingness to be drawn into a corporate dispute. However, all previous reports from NDV representatives indicated that the company was aware of the difficult situation unfolding around the development of the Pirogovskaya Riviera. This awareness has not yet forced retailers to abandon the sale of apartments in Mytishchi.
In addition, the position of the founders of KomforInvest, who own a controlling share of the capital (Stil LLC and Ilgar Hajiyev), is that there is no corporate conflict, but there is an illegal takeover of a group of companies. The founders claim that they won the court proceedings on the removal from office of N. Danilchenko, who is serving a sentence, Danilchenko’s tenure in office is the result of obstacles posed by third parties. On these facts, the founders have repeatedly appealed to law enforcement agencies.
