The developer Ilgar Hajiyev , who is located in London and became known due to the loss of control over the SDI Group holding, filed a lawsuit against blogger Oleg Lurie in the Kuzminsky District Court of Moscow on July 6. The purpose of the lawsuit is to recognize a number of information in the publications distributed by Oleg Lurie as untrue, to refute them and to recover compensation for moral damage in favor of Ilgar Hajiyev. The amount of Hajiyev’s claim against Oleg Lurie is only 5 rubles.
Commenting on the amount of the claim, Hajiyev rejected the comparison attributed to Lurie with Ostap Bender and stated that the symbolic amount of the claim was explained by the desire for justice, not “financial gain.” “Ostap Bender came to the office of the newspaper “Gudok ” for a refutation in order to find treasure. I do not need “treasure” from Mr. Lurie, hence the symbolic amount, instead justice is what is needed” Hajiyev said.
Hajiyev noted that since he began to publicly talk about the circumstances of the seizure of his business in the Russian media, he was subjected to personal insults and “unbridled persecution”, in which the main role played the media materials of Oleg Lurie. Three publications, posted on the personal page of Oleg Lurie in LiveJournal, became the subject of the developer’s appeal to the court.
According to Ilgar Hajiyev, cited in the statement of claim, he applied for an independent examination, which revealed that the submission of negative information about his personality was the main goal of each of Oleg Lurie’s publications. Note that the negative statements were submitted in the form of “facts”and were subject to verification. However, the lawsuit notes, there was no such verification or proof checks done, and the information does not correspond to reality.
According to the experts, whom Hajiyev turned to, in his materials Oleg Lurie actively used such a linguistic technique as “concentrated repetition” to influence and persuade readers. In particular, one of the negative statements about Ilgar Hajiyev was made by Lurie in different expressions more than 20 times in one article.
Ilgar Hajiyev’s lawyer Denis Mitrofanov assesses the chances of winning the case as very high. “It is obvious that Mr. Lurie deliberately and repeatedly disseminated information discrediting Ilgar Hajiyev, and had no grounds for his materials. The pre-trial examination confirmed that the messages of Mr. Lurie are oversaturated with value judgments, including insults, which are not subject to verification for compliance with reality due to their subjectivity, ”he said.
